The terms for using this site and SignalCheck.

1. Who we are

Red Beryl USA LLC (“Red Beryl,” “we,” “us”), 3340 Peachtree Rd NE, Atlanta, GA 30326, operates this site (“Site”) and SignalCheck (“Service”). Contact: nick@redberylusa.com, 404-924-6962.

2. Using the Site

Use the Site lawfully and without interfering with anyone else’s use of it. Do not attempt unauthorized access, disrupt its operation, scrape or republish its content at scale, or upload malicious code. We may suspend access for misuse.

3. SignalCheck

Tiers and prices. Basic (SignalCheck Presence) is free. Expanded is $500 for setup and consultation, then $250 per month. Full starts at $1,000 and is quoted for your business. Prices are in US dollars and may change; a change does not affect a subscription already running until its next renewal, with notice.

What you give us. To run the checks you invite Red Beryl to your Google Business Profile as a manager and, for Expanded and Full, grant viewer access to Google Analytics 4 and Search Console, and for Full send call, sales, station and contract data. You confirm you are authorized to grant that access and share that data, including any personal information of your customers in it. Our handling of it is described in the Privacy Policy.

What we do with it. Read-only analysis to produce your reports. We do not change settings, add or remove users, edit your listing, or share your data with a third party without your written approval.

Subscriptions and cancellation. Expanded renews monthly. Cancel any time by email; cancellation takes effect at the end of the current billing month and no further charges are made. Setup fees are not refundable once the setup call has taken place. Full-tier work is quoted and invoiced per its quote.

Reports. Reports are prepared for you from the data available to us at the time. They are our professional reading of that data, not a guarantee of any result. Where sources disagree we say so. You may use your reports inside your business freely; please do not publish them or pass them to a third party as Red Beryl’s work without asking.

4. No professional advice, no guaranteed results

Content on the Site, in our shows and in SignalCheck reports is general information and our opinion. It is not legal, financial or accounting advice. Marketing outcomes depend on many things outside our control, including your budget, market, competitors, execution and tracking setup. Nothing on the Site promises a particular result.

5. Consulting and production engagements

Consulting, Studios production and any custom work are governed by a separate written agreement (proposal, statement of work or services agreement). If that agreement and these terms conflict, the agreement controls.

6. Intellectual property

The Site, the shows, SignalCheck and their content are owned by or licensed to Red Beryl and protected by copyright and trademark law. Red Beryl, Red Beryl USA, SignalCheck, Marketing MadMen and Legacy of Luxury are our names and marks. You may view, share links to, and quote short excerpts of our published content with attribution. You may not reproduce, sell or create derivative works from it without written permission. Episode transcripts are published so that people and search engines can read them; republishing a transcript in full requires permission.

7. Guest appearances and submissions

If you appear on one of our shows, you grant Red Beryl the right to record, edit, publish and promote the episode and clips from it in any medium, indefinitely, with attribution to you. If you send us a pitch, a message or other material through the Site, you confirm you have the right to send it, and you allow us to use it to respond to you and evaluate your request.

8. Third-party services and links

The Site links to and embeds services we do not control, including Google, YouTube, Spotify, Apple Podcasts and FormSubmit. Their terms and privacy practices apply to your use of them. We are not responsible for third-party content.

9. Disclaimer of warranties

THE SITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY REPORT WILL BE COMPLETE OR ACCURATE, SINCE REPORTS DEPEND ON THIRD-PARTY DATA WE DO NOT CONTROL.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RED BERYL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING FROM THE SITE OR SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING.

11. Indemnification

You agree to defend and hold Red Beryl harmless from claims arising from your breach of these terms, your misuse of the Site or Service, or data you provided without the right to do so.

12. Termination

You may stop using the Site or cancel SignalCheck at any time. We may suspend or end access for a breach of these terms. Sections 4, 6, 7, 9, 10 and 11 survive termination.

13. Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Fulton County, Georgia, and you consent to their jurisdiction, unless the law where you live requires otherwise.

14. Changes

We may update these terms. The effective date at the top will change, and continued use after that date means you accept the update. Changes to SignalCheck pricing or renewal terms will be emailed to subscribers before they apply.
